- e) You are aware of the risks associated with using PerpVia’s services. These risks include the high volatility of Bitcoin and Ethereum themselves, and adverse market changes may cause you to lose all Bitcoin or Ethereum in your trading account;
- f) You will not engage in or initiate any form of market manipulation, including false orders or other behaviors;
- g) The information or documents you provide are accurate, truthful, and up-to-date;
- h) The Bitcoin or Ethereum withdrawal address you provide is your own address, and you have full control over it;
- i) Subscription to newsletters.
2.11 PerpVia will provide market data to facilitate users' use of the website. PerpVia makes no guarantees regarding the timeline, sequence, accuracy, or completeness of the market data, and you accept and agree that PerpVia is not liable for any inaccuracies, errors, delays, or omissions arising from your use of such market data.
2.12 PerpVia reserves the right to modify and/or terminate any or all services without prior notice to users.
2.13 PerpVia does not guarantee that the website will be uninterrupted or error-free. Among other things, the operation and availability of the PerpVia platform may be unpredictable and may be inaccessible from time to time. PerpVia assumes no liability for any interference that hinders your access to or use of this website and services.
2.14 PerpVia reserves the right to verify your identity at any time.
2.15 We may impose certain trading restrictions before requesting additional personal information about you and your transactions. Conducting business on this website indicates your agreement to cooperate with us in this process and provide all documents or information we may request.

3. Financial Advice

Except as otherwise specified in these Terms of Use, all trades are executed automatically based on the parameters of your order instructions and the published trade execution procedures. You should determine whether any investment, investment strategy, or related transaction is suitable for you based on your personal investment goals, financial condition, and risk tolerance, and you bear sole responsibility for any losses or liabilities.
4. Indemnification
4.1 You agree that if you incur any claims and expenses (including attorney fees) arising from your use of this website (including but not limited to your violation of this Agreement), you will indemnify and hold harmless PerpVia, its contractors, licensors, and their respective directors, senior management, employees, and agents from any and all such claims and expenses.
4.2 Under no circumstances shall PerpVia or its suppliers or licensors be liable for any of the following under contract, negligence, strict liability, or other legal or equitable theories:
- a) Any special, incidental, or consequential damages;
- b) The cost of purchasing or replacing products or services;
- c) Interruption of use, loss or damage to data; or amounts exceeding the fees you paid to PerpVia under this Agreement in the twelve (12) months prior to the cause of action.
PerpVia is not liable for any failure or delay in performance caused by matters beyond reasonable control. The foregoing does not apply to the extent prohibited by applicable law.
5. Calculations
5.1 All calculations executed by the PerpVia trading engine and verified by PerpVia are final and binding.
6. Limited Liability
6.1 Except to the maximum extent permitted by applicable law, PerpVia, our directors, employees, agents, suppliers, dealers, service providers, or other users shall not be liable under any circumstances for any direct, special, indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to loss of use, loss of profits, loss of information, business interruption, loss of revenue or goodwill, whether based on contract, tort (including negligence), or arising from use or inability to use this website, errors, omissions, interruptions, deletions, defects, viruses, operational or transmission delays, website malfunction, or any information transmitted to PerpVia.
6.2 To the maximum extent permitted by applicable law, the liability of PerpVia, our directors, employees, agents, suppliers, dealers, service providers, or other users shall not exceed the fees you paid to PerpVia within six (6) months prior to the cause of action, whether based on contract, warranty, tort (including negligence), product liability, strict liability, or any other cause arising from use or inability to use this website, errors, omissions, interruptions, deletions, defects, viruses, operational or transmission delays, or website malfunction.
6.3 If we are unable to perform the services under these Terms due to factors beyond our control (including but not limited to force majeure events, changes in laws, or sanction policy changes), we assume no liability for services provided during the occurrence of such events.
7. Intellectual Property
7.1 All intellectual property rights related to all materials used on this website (including but not limited to design, structure, layout, graphics, images, and underlying source code) are owned by PerpVia, and all rights are reserved.
7.2 By submitting content to any public area of this website (including blogs, message boards, and forums), you irrevocably grant a perpetual, royalty-free, non-exclusive right and license to us to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, publicly disclose, perform, and display (in whole or in part) such content worldwide, in any form, media, or technology now known or later developed, and to incorporate such content into other works. You also permit any subscribed user to access, display, view, store, and copy such content for personal use.
7.3 Logging into or using any services provided by this website does not transfer any intellectual property rights from us to you.
8. Termination of Agreement
8.1 This website has the right to terminate all services under this Agreement, and this Agreement shall terminate on the date all services of the website are terminated.

When registering a PerpVia account, you need to provide information including email, name, password, etc. To enhance account security, you can apply for Google or SMS two-factor authentication, which requires providing a phone number for SMS verification.

To comply with global industry regulatory standards including Anti-Money Laundering (AML), Know Your Customer (KYC), and Counter-Terrorism Financing (CTF), we are required to collect identity documents. This applies to both individual and corporate accounts.
9.1.3. Platform usage information
During the use of the PerpVia platform, we monitor and collect related data such as (including but not limited to) access date and time, device identifiers, operating system, browser, and IP address. This information may be obtained directly by PerpVia or third-party service providers. Collecting this data helps ensure our interface is suitable for users on all platforms and can also support criminal investigations.
9.1.4 Transaction information
For all corporate and individual accounts, we collect transaction information including (but not limited to) deposit snapshots, account balances, transaction records, withdrawals, order activities, and distribution records. This data collection is used to monitor suspicious trading behavior, prevent user fraud, and assist in legal case judgments.

We use your IP address and unique identifiers stored in cookies to verify your identity and provide services. Due to legal obligations and system requirements, we cannot provide services without identity proof, contact information, and transaction-related data.

Analyzing transaction activities to detect fraud and suspicious account fund flows early.

If identity is not verified before communication, we will not respond to submitted requests or issues. All communications are properly saved internally by PerpVia for accuracy review.
9.2.6 Enforcement of Terms of Use and other agreements
For PerpVia and our users, continuous review and monitoring to prevent potential violations are important. To protect user interests, we strictly enforce agreements signed with third parties and seriously investigate any violations of our Terms of Use. PerpVia reserves the right to provide services to any user involved in activities violating the Terms of Use.
How we protect user data:
PerpVia has implemented multiple security measures to ensure user information is not lost, misused, or altered. Our data security measures include but are not limited to: PCI scanning, Secure Socket Layer encryption technology, anonymization, internal data access restrictions, and strict office and archive access controls. However, electronic storage on the internet cannot guarantee 100% information security. Therefore, we recommend you understand and take independent security precautions to protect your personal information.
If you suspect that your personal information, especially account or password information, has been compromised, please immediately freeze your account and contact PerpVia customer service.
10. No Waiver Clause
10.1 Failure or delay by PerpVia to enforce any provision of these Terms or exercise any rights under these Terms shall not be deemed a waiver of such rights.
11. Changes to Terms
11.1 PerpVia reserves the right to change, add, or delete parts of these Terms at its sole discretion at any time. We will notify you of any significant changes in advance through your account. After receiving such notice, you are responsible for reviewing the revised Terms.
If you continue to use this website after we publish notice of changes to these Terms, you indicate your acceptance and agreement to the changes, and all your subsequent transactions shall be governed by the revised Terms.
12. Survival of Terms
